    Welcome to Amnesia Marketplace ("Amnesia", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our platform, products, and services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, you may not use the Services.

    Definitions

    • Account: Represents your legal relationship with Amnesia. A “Personal Account” represents an individual User’s authorization to log in to and use the Service and serves as a User’s identity on Amnesia. “Organizations” are shared workspaces associated with one or more Users, enabling collaboration across projects. A Personal Account can belong to multiple Organizations.
    • Content: Refers to content featured or displayed through the Website, including code, text, data, articles, images, photographs, graphics, software, applications, packages, designs, and other materials available on the Website or through the Service. “User-Generated Content” is Content created or uploaded by Users. “Your Content” is Content you create or own.
    • Amnesia: Refers to Amnesia Marketplace, as well as our affiliates, directors, subsidiaries, contractors, licensors, officers, agents, and employees.
    • User: Refers to the individual, company, or organization that visits or uses the Website or Service; accesses or uses any part of an Account; or directs the use of the Account in the performance of its functions. Users must be at least 16 years of age.
    • Service: Refers to the applications, software, products, and services provided by Amnesia.
    • Website: Refers to Amnesia’s website located at tryamnesia.com and all related content, services, and products.
    • Marketplace: Refers to Amnesia Marketplace website located at tryamnesia.com/marketplace and all related content, services, and products.

    Account Terms

    • Users: Subject to these Terms, you retain administrative control over your Personal Account and its Content.
    • Organizations: The "owner" of an Organization created under these Terms has administrative control over the Organization and its Content. Organizations may have multiple owners, with at least one Personal Account designated as an owner. Organization owners are responsible for actions performed under the Organization.
    • Eligibility: You must be at least 16 years old to use the Services.
    • Account Usage: A single login may not be shared by multiple people. Paid Organizations may provide access to as many Personal Accounts as their subscription allows.
    • Account Creation: Accounts must be created by humans; automated methods are not permitted, except for machine accounts explicitly allowed.

    Account Security

    • Responsibility: You are responsible for maintaining the security of your Account and password. Amnesia is not liable for any loss or damage resulting from failure to secure your Account.
    • Activity: You are responsible for all content posted and activity occurring under your Account.
    • Unauthorized Activity: Promptly notify Amnesia of any unauthorized activity by contacting [email protected].

    Acceptable Use

    • You agree not to use the Services for any unlawful purposes or in violation of any laws.
    • You must not engage in abusive, fraudulent, or disruptive behavior on the platform.

    Ownership and IP

    • Developers: Retain full ownership of their microservices.
    • Customers: Granted a perpetual, transferable, worldwide license to use, modify, and distribute purchased microservices.
    • Amnesia: Retains the rights to distribute microservices to multiple customers on the platform.

    Publishing and Selling Microservices

    • Developers: Can publish and sell microservices on the platform. By publishing, you grant Amnesia a license to display and distribute your microservices to users.
    • Ownership: Developers retain full ownership and rights to distribute and resell their microservices outside the platform.
    • Customers: Purchasing microservices grants full access to the source code, with rights to modify, distribute, and use it for commercial purposes.

    Fees, Payments, and Refund Policy

    • Fees: Amnesia may charge fees for transactions or services, disclosed before proceeding.
    • Pricing: Developers set pricing for their microservices, and Amnesia may take a commission from sales.
    • Taxes: You are responsible for paying applicable taxes.
    • Refunds: All purchases are final, and no refunds will be issued. Review purchases carefully before completing transactions.

    Termination

    • Amnesia Rights: We may suspend or terminate your account if you violate these Terms.
    • User Rights: You can terminate your account at any time by contacting us. Termination does not relieve obligations incurred before termination.
    • Developers: Upon account termination, Amnesia retains rights to sell your microservices on the platform.

    Disclaimers

    • The Services are provided "as is" without warranties of any kind.
    • While we adhere to best security practices, the quality of code depends on individual developers.

    Changes to These Terms

    • We may update these Terms at our discretion. Changes take effect upon posting, and continued use of the Services constitutes acceptance of the updated Terms.
